Exhibitors

This Sponsorship/Exhibitor Contract, including the terms and conditions attached hereto and incorporated herein by reference (collectively the “Contract”), is made by and between FYZICAL, LLC (“FYZICAL Brand Triumph Organizer”), located at 1751 Mound Street #102, Sarasota, FL. 34236, and the company identified below (”Company”). Upon execution of this Contract, Company agrees to pay the fees set forth below (“Total Fee”) in full subject to the Terms and Conditions attached hereto and incorporated herein by reference.

Cancellation Policy

All exhibitor cancellations must be made by providing written notice to FYZICAL Conference Organizer – kevin.mercier@fyzicalhq.com. 50% payment due at time of booth registration. Remaining balance due by May 1st, 2023. If registration is after 5/1/2023, 100% payment is due at time of registration. Company may cancel this Contract on or before 1/31/2023 without penalty.  If Company cancels between 2/1/2023 and 4/14/2023, company is responsible for 50% cancellation fee on total sponsorship. Following April 15^th, 2023, Company may cancel this Contract provided, however, that Company understands and agrees that such cancellation will be subject to a cancellation fee of 100% sponsorship fees as liquidated damages and not as a penalty. FYZICAL Conference Organizer may cancel this Contract at any time for convenience. Upon such cancellation for convenience by FYZICAL Conference Organizer, FYZICAL Conference Organizer shall refund any fees previously paid by Company under this Contract at request of exhibitor.

Photo / Video Release

Upon arrival at FYZICAL’s 2023 Brand Triumph event, you enter an area where photography, audio, and video recording may occur. By entering the event premises, you consent to interview(s), photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction to be used for news, web casts, promotional purposes, telecasts, advertising, inclusion on websites, social media, or any other purpose by FYZICAL and its affiliates and representatives. Images, photos and/or videos may be used to promote similar FYZICAL events in the future, highlight the event and exhibit the capabilities of FYZICAL. You release FYZICAL, its officers and employees, and each and all persons involved from any liability connected with the taking, recording, digitizing, or publication and use of interviews, photographs, computer images, video and/or or sound recordings. By entering the event premises, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, web casting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, web casting, or other publication irrespective of whether a fee for admission or sponsorship is charged. You also waive any right to inspect or approve any photo, video, or audio recording taken by FYZICAL or the person or entity designated to do so by FYZICAL. You have been fully informed of your consent, waiver of liability, and release before entering the event.

The individual submitting this registration Contract represents and warrants that he/she is duly authorized to execute this binding Contract on behalf of the Company.
